TERMS OF SALE

Any order placed and purchase made through the Site is subject to the Terms of Use together with these Terms of Sale.  If you do not agree to these Terms of Sale and Terms of Use, do not complete your order or purchase.  By completing your purchase or placing your order, you are agreeing to these Terms of Sale and the Terms of Use.


ORDER ACCEPTANCE

Nothing on this Site constitutes an offer, but an invitation by you to make an offer to purchase products through the Site.  All orders are subject to acceptance by Simply Medical.  Resale of products or services purchased through this Site is expressly prohibited. In addition, there may be certain orders that we cannot accept and must cancel. We reserve the right, in our sole discretion, to refuse or cancel any order for any reason, including without limitation the following:

  • Limitations on our ability to accept orders for shipment to addresses outside the United States
  • Limitations on quantities available for purchase
  • Inaccuracies or errors in product descriptions, images, or pricing information
  • Problems identified by credit and fraud avoidance services 

  • We may also require additional verifications, approvals or other information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. An order is deemed accepted when Simply Medical ships the products ordered, and Simply Medical will charge your credit or debit card upon such shipment. 


    PAYMENT

    Payment must be made by credit or debit card.  Payment by credit or debit card is subject to the approval of the card issuer, and Simply Medical will not be liable in any way if a card issuer refuses to accept a credit or debit card for any reason. 


    ORDER CANCELLATIONS

    Our goal is always to ship your orders promptly, so it often is not possible to cancel an order once it is processed. If you wish to cancel an order, please call our Customer Service Department at 1-855-374-6759 to see whether we can change, cancel or correct the order before it ships. 

    If your order has already shipped, you may be able to refuse delivery of your order or return your order in accordance with our Return Policy.  


    PRODUCT WARRANTY

    Simply Medical does not make any warranty with respect to the items available for purchase via the Site.  To the extent any items have warranties from their third party manufacturers, Simply Medical will use commercially reasonable efforts to assist you in receiving such warranty from the manufacturer.  

    THE FOREGOING WARRANTY IS THE ENTIRE AND EXCLUSIVE WARRANTY REGARDING THE ANY ITEMS AVAILABLE ON THE SITE AND IS IN LIEU OF ALL OTHER EXPRESS AND IMPLIED WARRANTIES WHATSOEVER.  EXCEPT AS PROVIDED HEREIN, SIMPLY MEDICAL MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ITEMS BEING SOLD, AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE HEREBY DISCLAIMED (INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE).  NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY SIMPLY MEDICAL, ITS AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF ANY WARRANTY, AND NO SUCH PERSONS HAVE AUTHORITY TO MODIFY ANY ASPECT OF ANY WARRANTY OR CREATE ANY OTHER WARRANTIES.  


    RETURN POLICY 

    Return of any product requires a return authorization in accordance with our Return Policy, incorporated into these Terms.  

    If you receive products from Simply Medical that you would like to return, please call our customer service department at 1-855-374-6759, or alternatively, please visit the Simply Medical website, log into your account and select the option to request a return. Please have your invoice number available when requesting a return authorization.  Simply Medical, at its expense, will arrange for return shipping of an item provided the request for a return is in accordance with our Return Policy.

    Upon our receipt of your returned item in our warehouse, we will confirm whether your item is eligible for return under the Return Policy.  If your return does not meet the Return Policy, we will notify you that your item is not eligible for return.  IF WE DETERMINE YOUR RETURN AS DELIVERED TO US IS NOT ELIGIBLE FOR RETURN UNDER OUR RETURN POLICY, NO CREDIT OR REFUND WILL BE ISSUED AND YOUR RETURNED PRODUCT WILL NOT BE RETURNED TO YOU. 

    If we are able to process your return in accordance with our Return Policy, credit will be issued back to your credit card within 2-4 weeks.  

    Returns will be processed and authorized for any products returned as a result of a recall or defective products and defective products will be replaced or repaired, depending on the manufacturer's policy.


    SHIPPING AND HANDLING; TAXES

    Unless otherwise noted, shipping and handling fees will be charged separately. Sales, use and similar taxes will be charged to you by Simply Medical to the extent required by law.

    Shipping on orders of $50.00 or more shipped to destinations in the continental United States is free.

    Shipping costs for orders less than $50.00 are your responsibility. Simply Medical will not ship any orders outside of the continental United States.


    TITLE AND RISK OF LOSS

    Title to products will pass to you when you receive the products, unless such products contain any embedded software.  Use of any embedded software may be subject to license restrictions imposed by the owner and licensor of such software and title to any embedded software within any product remains with the owner and licensor of such software. Simply Medical will bear the risk of loss or damage to the products during shipment to you.


    ORDER SHORTAGES

    If your order is incomplete upon delivery, please notify us immediately.  Any claims for order shortages must be submitted to Simply Medical within five business days of your receipt of the shipment.


    FSA Prospect Items

    Identifies products potentially reimbursable under a typical FSA account plan. Always check your employer’s plan document for specifics regarding eligible expenses under your spending account plan. Your employer’s plan document has final authority over what constitutes a reimbursable expense.
